Rules of Behaviour and Conduct | United Amstelveen

Behaviour rules are the general starting points for behaviour. The relationship between the trainer and the athlete is very important in sport. That is why NOC*NSF has set rules of conduct. United Amstelveen has established these regulations based on this. Respect, safety and equality are central values at United Amstelveen. These regulations are aimed at athletes, trainers, executives and parents/guardians (as defined in Article 1) and other members of United Amstelveen. The regulations are split into several articles.

The regulations consist of rules of behaviour and manners. The rules of behaviour for trainers indicate where the boundaries lie in the contact between trainer and athlete. The rules of conduct apply between athletes, trainers, executives and parents/guardians. When the regulations are violated, the disciplinary law of the KNGU applies and with that the Disciplinary Regulations for sexual harassment of the Sports Law Institute, to whom the KNGU has outsourced its disciplinary court.

With these regulations for behaviour and conduct rules United Amstelveen, the club shows that they will not accept sexual harassment, bullying and damage to its members. In addition, the rules of conduct published on the KNGU website also apply (the latest version of 12 May 2022 is included in Chapter 7 of the KNGU internal rules). In case of conflict the rules of the KNGU have priority over these regulations.

Every member, every athlete, trainer, executive and parent is supposed to know the rules of United Amstelveen and the KNGU and to act according to these rules. If mentioned he or him in these regulations it can also mean she or her.

Violation of the rules of conduct will lead to a disciplinary case that will be handled by the Disciplinary Committee and the Appeals Committee of the Institute for Sports Justice, a violation of the rules of conduct will lead to measures by the board of United Amstelveen if necessary. The board of United Amstelveen is entitled to suspend or expel an Athlete, a Trainer, an Executive Member, a member of which a Parent/Guardian does not comply with these regulations or a member in any other capacity or to deny access to locations where United Amstelveen practices gymnastics.

Violation of the rules of behaviour leads to a disciplinary case that is dealt with by the disciplinary committee and the Appeals Judicial Institute of the Sports Law Institute. A violation of the conduct rules, if necessary, leads to measures from the United Amstelveen board. The board of United Amstelveen is entitled to suspend or deny access to locations where United Amstelveen is practicing the sport to the following persons: an athlete, a trainer, a member, a member of which a parent/guardian does not comply with these regulations or a member in a different capacity.

Article 1. Definitions

  1. Executives: employees or volunteers who perform work as a board member or as a manager for United Amstelveen other than Trainers.
  2. Parents/guardians: parent and/or guardian of the Athlete, guardian of the Athlete and/or an adult person who temporarily takes care of the Athlete (such as a grandparent or a babysitter).
  3. Regulations: these rules of behaviour and conduct United Amstelveen.
  4. Athletes: gymnasts who practice gymnastics under the responsibility of United Amstelveen, these can be members but possibly also non-members such as members of another association who train with us.
  5. Trainer: trainer, assistant trainer, coach or competition supervisor who trains or supervises the athlete.

 Article 2. Rules of Conduct for Trainers

  1. The trainer must provide an environment and an atmosphere in which the athlete can feel safe and where everyone is respected.
  2. The trainer shall refrain from intruding further into the Athlete's private life than is necessary in the context of the practice of sport.
  3. The trainer refrains from any form of transgressive behaviour, abuse of power or sexual intimidation towards the athlete.
  4. Sexual acts and sexual relations between the trainer and the athlete are not permitted under any circumstances and are considered sexual abuse.
  5. The trainer may not touch the athlete in such a way that the athlete and/or the trainer can reasonably be expected to experience this touch as sexual or erotic in nature, as will usually be the case with the deliberate touching of genitals, buttocks and breasts.
  6. The trainer refrains from (verbal) sexual intimacies through any means of communication.
  7. The trainer will treat the athlete and the space in which the athlete is located, such as the dressing room or the hotel room, with respect during training (internships), competitions and travel, and only to the extent strictly necessary for the performance of his duties.
  8. The trainer has the duty - as far as is in his power - to protect the athlete against damage and abuse of power as a result of sexual harassment by others in gymnastics.
  9. The trainer has the right to deny an athlete access to the training if he has indications that the mental or physical health of an athlete is at stake.
  10. The trainer will not give the athlete any (im)material compensation with the apparent intention of asking for consideration. The trainer also does not accept any financial reward or gifts from the athlete that are disproportionate to the usual or agreed remuneration.
  11. The trainer will actively ensure that these rules are complied with by everyone involved with the athlete. If the trainer notices behaviour that is not in accordance with these rules of conduct, he will take the necessary action(s).
  12. In those cases where the rules of conduct do not (directly) provide, it is the responsibility of the Trainer to act in the spirit thereof.


Article 3. Rules of conduct for trainers, athletes, executives and parents/guardians: Respect Safety Equality
 

Within United Amstelveen, the following rules of conduct apply to everyone:

  1. I accept and respect the other person as he or she is and do not discriminate. Everyone counts within United Amstelveen.
  2. I take into account the boundaries set by the other person.
  3. I don't intrude any further into a private sphere other than necessary.
  4. I don't inflict any (emotional or material) damage on the other person.
  5. I am not abusing my position of power in any way.
  6. I don't swear, I don't intimidate, and I don't make mean jokes or comments about others.
  7. I don't ignore the other person.
  8. I don't participate in bullying, laughing or gossiping.
  9. I don't fight, I don't use violence, I don't threaten the other person, I don't take weapons.
  10. I don't get too close and don't touch the other person against his or her will.
  11. I don't give the other person unwanted sexual attention.
  12. I don't ask inappropriate questions or make unwanted comments about someone's personal life or appearance.

 Trainers, athletes, executives, parents/guardians and other members may hold each other accountable to these agreements and, if necessary, report to a trainer or the board if another person (including a parent/guardian or a (minor) Athlete) does not comply with them.

Article 4. Confidential counsellor

  1. United Amstelveen has an official trusted person who is appointed, suspended and dismissed by the general meeting of members. The appointment is made for a period of three years, after which reappointment is possible twice for a period of three years, up to a maximum of nine years.
  2. The trusted person cannot be an executive or trainer or someone who is involved in the practice of sports at United Amstelveen.
  3. The trusted person cannot take a policy or order measure, nor can he impose a penalty.

Article 5. Complaint

  1. Any member, i.e. including any trainer, athlete or parent, who believes that a rule of conduct or rules of conduct have been violated in respect of him/her/him, can submit a complaint to the trusted person. In the event of a criminal offence, the association advises to report it to the police.
  2. The trusted person conducts a brief factual investigation into the nature of the complaint and its seriousness and, in that context, hears the complainant and the person against whom the complaint is directed, or at least gives them the opportunity to be heard. The trusted person determines the way in which the complaint will be handled.
  3. If the seriousness of the complaint is minor and/or incidental in nature, the trusted person will handle the complaint himself and have a conversation with the complainant and with the person against whom the complaint is directed. The trusted person does not report this complaint to the board.
  4. In the event of complaints of a serious and/or structural nature, the trusted person will inform the board thereof. The board then decides whether to file a police report or report the complaint against the person against whom the complaint is directed or whether the board will bring the matter before the KNGU and/or with the (prosecutor of the) disciplinary committee of the Institute for Sports Justice. As soon as the trusted person has reported a complaint to the board, his intervention and activities in that matter end.
  5. In the event of complaints of a serious and/or structural nature, at the sole discretion of the board, the board may also decide to take disciplinary measures with the aim of preventing an undesirable situation from continuing or being able to occur again. 

Article 6. Regulations

  1. These regulations are adopted and amended by the general meeting of members of United Amstelveen. This December 7, 2023 version replaces the previous version dated June 17, 2020.
  2. These regulations apply to all trainers and executives who work at United Amstelveen, Athletes and parents/guardians and also to all members of United Amstelveen.
  3. In the event of any conflict between the Dutch and English versions of these regulations, the Dutch version shall prevail.
